(1) You have the following rights with respect to the personal data we hold about you:
a) Right of access, Art. 15 of the GDPR
Under Article 15 of the GDPR, you have the right to access your processed personal data. In particular, you may request information regarding the purposes of processing, the categories of personal data, the categories of recipients to whom your data has been or will be disclosed, the planned retention period, the existence of a right to rectification, erasure, restriction of processing, or objection, the existence of a right to lodge a complaint, and the origin of your data, provided that it was not collected by Saum & Viebahn GmbH & Co. d) Right to restriction of processing, Art. 18 of the GDPR
Pursuant to Article 18 of the GDPR, you may request the restriction of the processing of your stored personal data if you contest the accuracy of the data, the processing is unlawful but you oppose its erasure, and you no longer need the data, but you need it to assert, exercise, or defend legal claims, or you have objected to the processing pursuant to Article 21 of the GDPR.
e) Right to data portability, Art. 20 of the GDPR
You have the right to receive the personal data concerning you that you have provided in a structured, commonly used, and machine-readable format. (2) You also have the right to file a complaint with the supervisory authority. See the list of supervisory authorities for the non-public sector.
§ 3 Collection of Personal Data When Visiting Our Website
(1) When you use the website for informational purposes only—that is, if you do not register or otherwise provide us with information—we collect only the personal data that your browser transmits to our server via so-called server log files. When you view our website, we collect the following data, which is technically necessary for us to display our website to you and to ensure its stability and security (the legal basis is Art. 6(1), sentence 1, lit. f
GDPR):
– IP address – Date and time of the request
– Time zone difference from Greenwich Mean Time (GMT)
– Content of the request (specific page)
– Access status/HTTP status code
– Amount of data transferred in each case
– Website from which the request originates
– Browser – Operating system and its user interface
– Language and version of the browser software.
(2) In addition to the data mentioned above, cookies are stored on your computer when you use our website. Cookies are small text files that are stored on your hard drive and associated with the browser you are using, and through which certain information is transmitted to the entity that sets the cookie (in this case, us). Cookies cannot run programs or transfer viruses to your computer. They serve to make the website more user-friendly and effective overall.
(3) Use of Cookies:
a) This website uses the following types of cookies, the scope and functionality of which are explained below:
– Transient cookies (see b)
– Persistent cookies (see c).
b) Transient cookies are automatically deleted when you close your browser. These include, in particular, session cookies. These cookies store a so-called session ID, which allows various requests from your browser to be associated with the same session. This enables your computer to be recognized when you return to our website. Session cookies are deleted when you log out or close your browser.
c) Persistent cookies are automatically deleted after a specified period, which may vary depending on the cookie. You can delete these cookies at any time in your browser's security settings.
d) Use of Google Analytics
On this website, we use Google Analytics in particular. The provider is Google Ireland Limited (“Google”), Gordon House, Barrow Street, Dublin 4, Ireland. This is a web analytics service provided by Google Inc. that uses cookies. The information generated by the cookies regarding your visit to and use of our website is generally transmitted to a Google server in the United States and stored there. However, because IP anonymization is enabled on this website, your IP address will be truncated by Google beforehand within member states of the European Union or in other signatory states to the Agreement on the European Economic Area. Only in exceptional cases is the full IP address transmitted to a Google server in the United States and truncated there. On behalf of the operator of this website, Google will use this information to evaluate your use of the website, to compile reports on website activity, and to provide other services related to website and internet usage to the website operator. The IP address transmitted by your browser as part of Google Analytics is not combined with other data held by Google. You can prevent cookies from being stored by adjusting the settings in your browser. You can also prevent Google from collecting the data generated by the cookie and related to your use of the website (including your IP address) and from processing this data. To do so, use the following link to download and install the available browser plug-in: tools.google.com/dlpage/gaoptout. In addition to or as an alternative to the browser add-on, you can prevent tracking by Google Analytics on our website by installing an opt-out cookie (Disabling Tracking). This will prevent Google Analytics from collecting data for this website and this browser in the future, as long as the cookie remains installed in your browser.
e) You can configure your browser settings according to your preferences and, for example, refuse to accept third-party cookies or all cookies. Please note that you may not be able to use all features of this website.
f) Use of Google Web Fonts On this website, we use the Google Web Fonts script/font library to ensure that our content is displayed correctly across all browsers. The provider is Google Ireland Limited (“Google”), Gordon House, Barrow Street, Dublin 4, Ireland. Google Web Fonts are stored in your browser’s cache to avoid repeated loading, so that a connection to Google, the library’s operator, is automatically established when you access the site. Consequently, it is at least theoretically possible that the library operator collects data, although it is unclear whether and, if so, for what purposes this data is collected. This is governed by Google’s privacy policy, which you can find at the following link: www.google.com/policies/privacy/.
g) We use cookies to identify you on subsequent visits if you have an account with us. Otherwise, you would have to log in again each time you visit. § 4 Additional Features and Services on Our Website
(1) In addition to the purely informational use of our website, we offer various services that you may use if you are interested. To do so, you will generally need to provide additional personal data, which we use to provide the respective service and to which the aforementioned data processing principles apply.
(2) In some cases, we use external service providers to process your data. We have carefully selected and engaged these providers; they are bound by our instructions and are regularly monitored.
(3) Furthermore, we may share your personal data with third parties if we offer promotions, sweepstakes, contracts, or similar services in collaboration with partners. You can find more detailed information about this when you provide your personal data or in the description of the offer below.
(4) If our service providers or partners are based in a country outside the European Economic Area (EEA), we will inform you of the implications of this in the description of the offer.
§ 5 Objection or Withdrawal of Consent to the Processing of Your Data
(1) If you have given your consent to the processing of your data, you may revoke it at any time. Such a revocation affects the lawfulness of the processing of your personal data after you have notified us of it.
(2) To the extent that we base the processing of your personal data on a balancing of interests, you may object to such processing. This is the case, in particular, when the processing is not necessary for the performance of a contract with you, as we will explain in each instance in the following description of the functions. If you exercise such a right to object, we ask that you explain the reasons why we should not process your personal data as we currently do. In the event of a justified objection, we will review the situation and either cease or adjust the data processing, or explain to you our compelling legitimate grounds for continuing the processing.
(3) Of course, you may object at any time to the processing of your personal data for advertising and data analysis purposes. You can notify us of your objection to advertising using the following contact information: Saum & Viebahn GmbH & Co. KG, E.-C.-Baumann-Str. 12, 95326 Kulmbach, Email: marketing@saum-und-viebahn.de, Phone: 09221-800220
§ 6 Specific Ways to Use Our Website
1. Registration on Our Website
a) When you register on our website to use our personalized services, we collect personal data such as your name, address, phone number, and email address. By registering, you can access services and content that we offer only to registered users.
b) As part of your registration, you also have the option to change or delete the data provided in connection with the registration if necessary. Of course, you may request information from us at any time regarding the personal data we have stored about you. You may also request that we correct or delete your data, provided that no legal retention requirements prevent us from doing so. You can contact us using the following contact information: Saum & Viebahn GmbH & Co. KG, E.-C.-Baumann-Str. 12, 95326 Kulmbach, Email: marketing@saum-und-viebahn.de, Phone: 09221-800220
2. Social Media
a) Use of Social Media Plug-Ins
aa) We currently use the following social media plug-ins: Facebook, Pinterest, and Instagram. We use what is known as the “two-click solution.” This means that when you visit our site, no personal data is initially shared with the plug-in providers. You can identify the plug-in provider by the label in the box, which displays its initial letter or logo. We provide you with the option to communicate directly with the plug-in provider via the button. Only when you click on the marked field and thereby activate it does the plug-in provider receive the information that you have accessed the corresponding page of our website. In addition, the data specified in § 3 of this statement is transmitted.
About Facebook: Our website uses so-called social plugins (“plugins”) from the social network Facebook, which is operated by Facebook Inc., 1601 S. California Ave, Palo Alto, CA 94304, USA (“Facebook”). The plugins are identified by a Facebook logo or the label “Facebook Social Plugin.” You can find an overview of the Facebook plugins and what they look like here: developers.facebook.com/plugins
When you visit a page on our website that contains such a plugin, your browser establishes a direct connection to Facebook’s servers. The plugin’s content is transmitted directly from Facebook to your browser and integrated into the page. Through this integration, Facebook receives the information that your browser has accessed the corresponding page of our website, even if you do not have a Facebook profile or are not currently logged in to Facebook. This information (including your IP address) is transmitted directly from your browser to a Facebook server in the United States and stored there. If you are logged in to Facebook, Facebook can immediately associate your visit to our website with your Facebook profile. If you interact with the plugins—for example, by clicking the “Like” button or posting a comment—this information is also transmitted directly to a Facebook server and stored there. The information is also published on your Facebook profile and displayed to your Facebook friends.
For information on the purpose and scope of data collection, as well as the further processing and use of the data by Facebook, and your related rights and privacy settings, please refer to Facebook’s privacy policy: www.facebook.com/policy.php If you do not want Facebook to directly associate the data collected via our website with your Facebook profile, you must log out of Facebook before visiting our website. You can also completely prevent the Facebook plugins from loading by using browser add-ons, such as the “Facebook Blocker” or the script blocker “NoScript” (http://noscript.net/).
About Pinterest: On our website, we use social plugins from the social network Pinterest, which is operated by Pinterest Inc., 635 High Street, Palo Alto, CA 94301, USA (“Pinterest”). When you visit a page that contains such a plugin, your browser establishes a direct connection to Pinterest’s servers. In doing so, the plugin transmits log data to Pinterest’s servers in the United States. This log data may include your IP address, the addresses of the websites you have visited that also contain Pinterest features, your browser type and settings, the date and time of the request, how you use Pinterest, and cookies. If you are logged into Pinterest in the same browser while visiting our site, this information may be linked to your profile. You can adjust your privacy settings on Pinterest at pinterest.com/about/privacy/. If you do not consent to the transfer of your data to Pinterest, please log out of Pinterest in the browser you are using to visit our site.
For more information on the purpose, scope, and further processing and use of data by Pinterest, as well as your rights in this regard and options for protecting your privacy, please refer to Pinterest’s Privacy Policy: about.pinterest.com/de/privacy-policy. Regarding Instagram: Features of the Instagram service are integrated into our pages. These features are provided by Instagram Inc., 1601 Willow Road, Menlo Park, CA, 94025, USA. If you are logged into your Instagram account, you can link the content of our pages to your Instagram profile by clicking the Instagram button. This allows Instagram to associate your visit to our pages with your user account. Please note that, as the provider of these pages, we have no knowledge of the content of the transmitted data or its use by Instagram.
For more information on this, please see Instagram’s Privacy Policy.
bb) We have no control over the data collected or the data processing operations, nor are we aware of the full scope of data collection, the purposes of processing, or the retention periods. We also have no information regarding the deletion of the collected data by the plug-in provider.
cc) The plug-in provider stores the data collected about you as usage profiles and uses this data for advertising, market research, and/or to tailor its website to your needs. Such analysis is carried out in particular (even for users who are not logged in) to display targeted advertising and to inform other users of the social network about your activities on our website. You have the right to object to the creation of these user profiles; to exercise this right, you must contact the respective plug-in provider. Through the plug-ins, we offer you the opportunity to interact with social networks and other users, enabling us to improve our services and make them more interesting for you as a user. The legal basis for the use of the plug-ins is Article 6(1)(f) of the GDPR.
dd) Data is shared regardless of whether you have an account with the plug-in provider and are logged in there. If you are logged in with the plug-in provider, the data we collect about you is directly associated with your existing account with the plug-in provider. If you click the activated button—for example, to share the page—the plug-in provider will also store this information in your user account and share it publicly with your contacts. We recommend that you log out of social networks regularly after use, and especially before clicking the button, as this will help you avoid having this information linked to your profile with the plug-in provider.
ee) For more information on the purpose and scope of data collection and its processing by the plug-in provider, please refer to the privacy policies of these providers listed below. There you will also find further information about your rights in this regard and the settings available to protect your privacy.

b) Embedding YouTube Videos
aa) We have embedded YouTube videos in our online content that are stored at www.YouTube.com and can be played directly from our website. [These are all embedded in “enhanced privacy mode,” which means that no data about you as a user is transmitted to YouTube unless you play the videos. Only when you play the videos is the data described in paragraph 2 transmitted. We have no control over this data transmission].
bb) When you visit the website, YouTube receives information indicating that you have accessed the corresponding page on our website. In addition, the data specified in Section 3 of this statement is transmitted. This occurs regardless of whether you are logged in to a YouTube user account or do not have a user account. If you are logged in to Google, your data will be directly associated with your account. If you do not wish for this data to be associated with your YouTube profile, you must log out before clicking the button. YouTube stores your data as usage profiles and uses them for advertising, market research, and/or to tailor its website to your needs. Such analysis is carried out in particular (even for users who are not logged in) to deliver targeted advertising and to inform other users of the social network about your activities on our website. You have the right to object to the creation of these user profiles; to exercise this right, you must contact YouTube.

c) Integration of Google Maps
aa) We use Google Maps on this website. The provider is Google Ireland Limited (“Google”), Gordon House, Barrow Street, Dublin 4, Ireland. This allows us to display interactive maps directly on the website and enables you to conveniently use the map feature.
bb) When you visit the website, Google receives information that you have accessed the corresponding page of our website. In addition, the data specified in § 3 of this statement is transmitted. This occurs regardless of whether Google provides a user account through which you are logged in or whether no user account exists. If you are logged in to Google, your data is directly associated with your account. If you do not wish for this data to be associated with your Google profile, you must log out before activating the button. Google stores your data as usage profiles and uses them for advertising, market research, and/or to tailor its website to your needs. Such analysis is carried out in particular (even for users who are not logged in) to deliver targeted advertising and to inform other users of the social network about your activities on our website. You have the right to object to the creation of these user profiles; to exercise this right, you must contact Google.
cc) For more information on the purpose and scope of data collection and its processing by the plug-in provider, please refer to the provider’s privacy policy.
